Acceptance of Terms

By downloading, installing, or using SPILL ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and The Hale ("we," "us," or "our"), the company that develops and operates SPILL.

We recommend reading these Terms in full, but here's the gist: be 18+, drink responsibly, don't do anything illegal, and have fun.

Age Requirement

You must be at least 18 years old to use SPILL. The App contains references to alcohol consumption and is rated 17+ on iOS and High Maturity on Android.

By using the App, you confirm that you are of legal drinking age in your jurisdiction. The App includes an age verification gate at first launch. If you are not of legal age, you must not use the App.

We do not knowingly allow access to anyone under 13 years of age, in compliance with the Children's Online Privacy Protection Act (COPPA). If you are a parent or guardian and believe your child has accessed the App, please contact us at hello@thehale.ca.

About the App

SPILL is a mobile party game where players take turns responding to prompt cards that include dares, confessions, group challenges, voting rounds, and drinking rules. The App is designed for social entertainment among consenting adults.

The App includes:

• Multiple game modes with 847+ unique prompt cards
• A built-in recording feature to capture and share moments to social media
• Optional in-app purchases for additional game modes, cosmetic themes, and power-ups
• Local game statistics and player history

SPILL runs entirely on your device. There are no user accounts, no cloud sync, and no backend servers storing your data.

Permitted Use

You may use SPILL for personal, non-commercial entertainment purposes. You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute the App or its content
• Use the App for any illegal purpose or in violation of any applicable laws
• Attempt to circumvent any security features or purchase verification systems
• Use the App in a way that could harm, disable, or impair it
• Reproduce, republish, or redistribute the prompt content from the App
• Use automated scripts, bots, or other methods to extract content from the App

In-App Purchases

SPILL offers optional one-time in-app purchases. We do not offer subscriptions. Available purchases include:

Payment & Refunds

• All purchases are processed through the Apple App Store or Google Play Store. We do not process payments directly.
• Purchases are non-refundable through us. If you need a refund, you must contact Apple Support or Google Play Support directly.
• Prices may vary by region and are set in accordance with app store pricing tiers.
• Purchase entitlements are managed by RevenueCat and can be restored on a new device through the App's restore purchases feature.

Consumable Items

Power-ups are consumable items. Once used, they are gone. Power-up inventory counts are stored locally on your device. If you delete the App, unused power-ups may be lost and cannot be restored.

User Content

SPILL's recording feature allows you to capture video during gameplay with prompt text overlays. Regarding recorded content:

• You own your recordings. Videos you record using SPILL are your property. We do not claim any ownership over user recordings.
• Recordings are stored locally on your device. We never access, collect, or store your videos.
• If you choose to share recordings to social media (TikTok, Instagram, etc.), that sharing is between you and those platforms. We have no involvement in or control over content you share externally.
• Recordings include the SPILL watermark and prompt overlay. By using the recording feature, you agree to include these elements in the exported video.

You are solely responsible for the content you record and share. Please ensure any recordings comply with the laws in your jurisdiction, including consent laws for recording other people.

Intellectual Property

All intellectual property rights in SPILL belong to The Hale. This includes but is not limited to:

• The SPILL brand name, logo, and visual identity
• All prompt card content, text, and game mechanics
• App design, user interface, and user experience
• The "Kinetic Lounge" design system and visual language
• All source code, software, and technical infrastructure
• Marketing materials, website content, and documentation

You may not copy, reproduce, distribute, or create derivative works based on any part of SPILL without our prior written consent.

The SPILL watermark included in video recordings is part of the App's functionality and must not be removed, altered, or obscured.

Health & Safety Disclaimer

SPILL is an entertainment app. It is not a guide to drinking and should not be treated as one.

• Drink responsibly. Always know your limits. You are never obligated to drink or perform any dare suggested by the App.
• Prompts involving drinking are suggestions for entertainment purposes only. You may skip any prompt at any time.
• We strongly encourage players to set personal limits before playing and to use the sip intensity setting to adjust gameplay.
• Never drink and drive. Always have a designated driver or alternative transportation plan.
• If you or someone you know is struggling with alcohol, please contact the SAMHSA National Helpline at 1-800-662-4357.

The Hale is not responsible for any injury, harm, illness, legal consequences, or damages that may result from activities performed while using the App. You use SPILL entirely at your own risk and assume full responsibility for your actions and decisions while playing.

No Warranty

SPILL is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

We do not warrant that the App will be compatible with all devices, that it will be free of bugs or errors, or that any content will be accurate or appropriate for all audiences.

Limitation of Liability

To the maximum extent permitted by applicable law, The Hale and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the App
• Any actions taken or not taken as a result of using the App
• Any content or prompts displayed within the App
• Loss of locally stored data due to device failure, App deletion, or other causes
• Unauthorized access to or alteration of your device data
• Any third-party conduct or content related to the App

In no event shall our total liability exceed the amount you paid for in-app purchases in the twelve (12) months preceding the event giving rise to the claim, or $50 USD, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless The Hale and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any content you record or share using the App's recording feature
• Any harm caused by your actions during gameplay

Termination

You may stop using the App at any time by uninstalling it from your device. We may also terminate or restrict your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms.

Upon termination:

• Your license to use the App is immediately revoked
• Any locally stored data will remain on your device until you delete the App
• Purchases made through app stores are governed by the respective store's policies
• Sections of these Terms that by their nature should survive termination will continue to apply (including Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law)

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the use of the App shall be resolved through the courts located in Ontario, Canada. You agree to submit to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the App.

Your continued use of SPILL after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, please stop using the App.
